1. About Novus Miami and the Service
Novus Miami is an independent real estate information and technology platform designed to help consumers, real estate professionals, and developers discover, research, organize, and compare new-development residential real estate projects in Miami and surrounding South Florida markets.
The Service may include project information, neighborhood information, search and comparison tools, saved favorites and collections, communications, inquiries, and other real estate research tools.
Novus Miami is not a developer, project owner, condominium association, or official developer sales office unless expressly stated otherwise. The Service is provided for informational purposes and does not constitute legal, tax, financial, investment, or other professional advice.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service.
If you use the Service on behalf of a company, brokerage, developer, or other organization, you represent that you have authority to act on behalf of and bind that organization to these Terms.
3. Accounts
Certain features of the Service may require an account.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You agree to provide accurate, current, and complete information and to keep your account information reasonably up to date.
You may be able to sign in using email and password or a supported third-party authentication provider. Your use of a third-party provider is also subject to that provider’s applicable terms and policies.
We may restrict, suspend, or terminate an account if we reasonably believe it has been used in violation of these Terms, applicable law, or in a manner that threatens the security or integrity of the Service or other users.
4. Acceptable Use
You agree not to:
- Scrape, crawl, harvest, systematically download, reproduce, or extract project data, listings, photographs, floor plans, user information, or other content for redistribution, resale, database creation, or unauthorized commercial use.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying technology of the Service except where applicable law expressly permits it.
- Circumvent or attempt to circumvent security measures, access restrictions, rate limits, or other technical protections.
- Use the Service to distribute spam, unauthorized advertising, or unsolicited communications.
- Impersonate another person or entity or misrepresent your identity, professional status, brokerage affiliation, developer affiliation, or other relationship.
- Interfere with, damage, disrupt, or attempt to gain unauthorized access to the Service, its systems, accounts, or networks.
- Upload, transmit, or submit content that is unlawful, fraudulent, defamatory, discriminatory, infringing, malicious, or otherwise violates applicable law or the rights of another person.
- Use the Service for any unlawful purpose.
5. Property Information and Website Disclaimer
Information provided through Novus Miami is for general informational purposes only and may be based on developer materials, public records, listings, brokerage information, third-party data, and other sources believed to be reliable. Novus Miami does not guarantee the accuracy, completeness, or timeliness of such information.
Pricing, availability, floor plans, residence sizes, dimensions, fees, assessments, deposit structures, amenities, rental policies, construction status, completion dates, specifications, incentives, and other project details may change at any time without notice. Users should independently verify information material to a purchase, lease, investment, or other real estate decision through applicable official developer, condominium, association, contractual, disclosure, and offering documents.
Renderings, photographs, illustrations, floor plans, maps, dimensions, views, distances, finishes, furnishings, landscaping, and other visual or descriptive materials may be conceptual, illustrative, or approximate and may differ from completed improvements or actual conditions.
The inclusion of a project, developer, brand, brokerage, real estate professional, service provider, or other third party on Novus Miami does not, by itself, constitute or imply an affiliation, sponsorship, endorsement, partnership, agency relationship, or exclusive relationship.
Information concerning short-term rentals, rental programs, Airbnb or other hosting platforms, lease terms, rental eligibility, or rental restrictions is provided for informational purposes only. Rental use may be governed or restricted by condominium documents, association rules, management agreements, developer requirements, governmental regulations, licensing requirements, platform rules, or other restrictions that may change. Users should independently verify current rental rules before purchasing or relying on such information.
Nothing presented through the Service constitutes a representation, promise, projection, or guarantee of rental income, occupancy, appreciation, resale value, investment return, tax treatment, or future performance.
Prospective purchasers and other users should independently investigate matters material to their decisions, review applicable contracts, offering documents, condominium documents, budgets, association rules, disclosures, and other governing documents, and consult qualified legal, tax, financial, real estate, or other professional advisors as appropriate.
School information, attendance boundaries, ratings, distances, travel times, neighborhood information, nearby destinations, and similar information are provided for general reference only and may change. Users should independently verify information material to their decisions with the appropriate source.
In the event of a discrepancy between information displayed through Novus Miami and applicable official developer, condominium, association, contractual, disclosure, or offering documents, the applicable official documents shall control.

6. Real Estate Professionals, Inquiries, and Referrals
Novus Miami may allow consumers to use the Service independently or in connection with a real estate professional.
Real estate professionals using the Service may be affiliated with independent real estate brokerages and are responsible for complying with applicable licensing, brokerage, advertising, disclosure, and professional requirements.
If a consumer is connected with a participating real estate professional, inquiries submitted through the Service may be routed to that professional. If a consumer is not connected with a real estate professional, an inquiry may be routed to a participating licensed real estate professional or brokerage that may be able to assist.
Submitting an inquiry, creating an account, saving a project, or otherwise using Novus Miami does not, by itself, establish a brokerage, agency, fiduciary, representation, or other professional relationship between a user and Novus Miami or between a user and a real estate professional. Any such relationship must be established separately in accordance with applicable law and brokerage requirements.
Any brokerage representation, commission arrangement, referral arrangement, purchase agreement, reservation, lease, or other real estate transaction is governed by the applicable agreements and parties involved. Unless expressly stated otherwise, Novus Miami is not a party to a real estate purchase, lease, brokerage, or developer agreement entered into through or as a result of use of the Service.
7. Favorites, Comparisons, Collections, and Other Tools
The Service may allow users to save favorites, compare projects, create collections, save searches, communicate with other users or professionals, and use other organizational or research tools.
These features are provided for convenience and may be changed, suspended, or discontinued. While we take reasonable measures to operate the Service reliably, we do not guarantee that saved information, collections, messages, comparisons, or other user data will always remain available.
8. Intellectual Property
The Service, including its software, design, layout, branding, logos, text created by Novus Miami, databases and compilations, and the selection and arrangement of content, is owned by Novus Miami or its licensors and is protected by applicable intellectual-property laws.
Subject to these Terms, Novus Miami grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for lawful personal real estate research or, where applicable, legitimate professional use in connection with your real estate business and clients.
Project names, developer names, trademarks, renderings, photographs, floor plans, logos, marketing materials, and other third-party content remain the property of their respective owners or licensors. Their appearance on Novus Miami does not transfer ownership to Novus Miami or to users of the Service.
Nothing in these Terms grants you permission to reproduce, distribute, sell, license, publish, or commercially exploit Service content except as expressly permitted by Novus Miami, the applicable rights holder, or law.
9. User Content and Communications
You may submit information or content through the Service, including profile information, messages, inquiries, notes, preferences, or other materials (“User Content”).
You retain any ownership rights you may have in your User Content. By submitting User Content, you grant Novus Miami a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display that content to the extent reasonably necessary to operate, maintain, improve, and provide the Service and the features you request.
You represent that you have the right to submit your User Content and that doing so does not violate applicable law or the rights of another person.
10. Third-Party Services and Links
The Service may contain links to or integrate with websites, services, listings, maps, authentication providers, developers, brokerages, or other third parties.
Novus Miami does not control third-party services and is not responsible for their content, availability, accuracy, security, privacy practices, products, services, or terms. Your use of third-party services is governed by the applicable third party’s terms and policies.
11. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied.
Novus Miami does not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components, or that defects will always be corrected. Novus Miami makes no warranty regarding results obtained from use of the Service or the accuracy, reliability, availability, or completeness of information provided through it.
Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Novus Miami and its affiliates, officers, directors, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising out of or relating to the Service or these Terms.
To the maximum extent permitted by applicable law, Novus Miami’s aggregate liability arising out of or relating to the Service or these Terms will not exceed US$100.
These limitations apply only to the extent permitted by applicable law.
13. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Novus Miami and its affiliates, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs and expenses, including attorneys’ fees, arising from or relating to your misuse of the Service, your User Content, your violation of these Terms, or your violation of applicable law or the rights of another person.
14. Suspension and Termination
You may stop using the Service at any time and may use available account-management features to close your account where provided.
Novus Miami may restrict, suspend, or terminate access to some or all of the Service when reasonably necessary to enforce these Terms, comply with law, address security or technical concerns, prevent fraud or abuse, or protect Novus Miami, its users, or third parties.
Provisions that by their nature should survive termination will remain in effect, including provisions concerning intellectual property, disclaimers, limitations of liability, indemnification, and governing law.
15. Changes to the Service and These Terms
Novus Miami may modify or discontinue features of the Service and may update these Terms from time to time.
When these Terms are updated, the “Last updated” date will be revised. Where required by applicable law, additional notice of material changes will be provided.
Your continued use of the Service after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

17. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles.
To the extent permitted by applicable law, disputes arising out of or relating to these Terms or the Service will be subject to the jurisdiction of the applicable state or federal courts located in Miami-Dade County, Florida.
18. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
19. Entire Agreement
These Terms, together with the Privacy Policy and any additional terms expressly applicable to particular features of the Service, constitute the agreement between you and Novus Miami concerning your use of the Service and supersede prior terms concerning that use.
